“A person riding a bicycle or operating a pedicab upon a highway has all the rights and is subject to all the provisions applicable to the driver of a vehicle by this division, including, but not limited to, provisions concerning driving under the influence of alcoholic beverages or drugs”

Consequence

California Vehicle Code section 42001 allows universities and state colleges to set a fine schedule for bicycle violations occurring in their jurisdictions that would superseded the Judicial Council penalty schedule.

In Yolo County the consequences for a BUI are a fine of up to $730 and possible documentation on your driving record. If you are under 21, your driving privilege will be suspended for one year or delayed for one year once you are eligible to drive.

In California, a bicyclist has all the rights and responsibilities as motor vehicle drivers, which is why you can't ride against traffic. It is against the law to ride a bicycle on a street or highway while under the influence of alcohol and/or drugs.
