Felony DUI or DUI with Injury

A DUI can be a felony if someone was injured, you had at least 2 or more subsequent DUIs within a ten year period, or one previous felony DUI.



-2-4 years in state prison

-Fine not less than 1,500 dollars nor more than 5,000

-Up to 5 years license suspended



-Not less than 90 days, nor more than one year (one more year of jail per each injured victim – section 23558 – up to 3)

-Must surrender the driver’s license for at least one year


When you drive under the influence, you risk not only harming yourself but harming others. If you harm someone else, the consequences become even more harsh.
